Welcome to the FoodDiscovery App ("App")! These Terms of Service ("Terms") are an agreement between you and FoodDiscovery LLC ("we," "us," or "our") and govern your use of the App. Please read them carefully.
By using the App, you agree to be bound by these Terms. If you disagree, do not use the App.
Account Creation
- To use certain features, you'll need to create an account.
- You must be at least 13 years old to create an account.
- Be honest with the information you provide and keep your account secure.
- You agree that your account may be terminated if we believe, in our sole discretion, that the information provided violates our policies or the law.
User Content
- You may post reviews, photos, videos, and other content ("User Content").
- You grant us a non-exclusive, worldwide, royalty-free, transferable license to use, copy, modify, display, and distribute your User Content in connection with the App and our promotional activities. This license ends when you delete your content or account.
- You ensure that you own or have the rights to post your User Content. You will be solely responsible for any claims or losses stemming from your User Content.
- We may remove User Content, without notice, if we deem it inappropriate, unlawful, violates our Terms, or infringes on others' rights.
Prohibited Activities
You may not use the App:
- In any way that violates laws or regulations.
- To post content that is hateful, threatening, harmful, sexually explicit, promotes violence, or violates the rights of others.
- To spam, impersonate others, or engage in fraudulent activity.
- To harm or interfere with the App's operation.
- To post private or confidential information about others without permission.
Our Intellectual Property
The App's content, design, logos, code, and other elements are protected by intellectual property rights. You may not use them without our written permission.
Location Usage
The App may access your location data to provide location-based features, like recommending nearby restaurants. With your permission, we may use this data to improve our services and offer personalized content. You can manage location permissions within your device settings.
No Warranties
THE APP IS PROVIDED "AS IS," WITHOUT ANY GUARANTEES. WE ARE NOT RESPONSIBLE FOR ERRORS, INTERRUPTIONS, OR LOSSES CAUSED BY USING THE APP.
Limitation of Liability
OUR LIABILITY FOR DAMAGES ARISING FROM YOUR USE OF THE APP IS LIMITED AS MUCH AS THE LAW ALLOWS. THIS INCLUDES DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
Termination
We may terminate or suspend your account at any time, for any reason, without notice.
Permissions
You give us permission to display your username, profile picture, and information about your actions (like reviews, follows) alongside sponsored content or ads shown on the App. We may also utilize your general, non-personal data to tailor the ads displayed to you.
Mobile Terms of Service
The FoodDiscovery mobile message service (the "Service") offered through FoodDiscovery ("FoodDiscovery", "we", or "us") is provided by third-party Braze. Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms").
By consenting to the Service, you agree to receive recurring SMS/text messages from and on behalf of FoodDiscovery through your wireless provider to the mobile number you provided.
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with FoodDiscovery. Your participation in this program is completely voluntary.
Content Removal and Account Disabling
We may remove content or disable/terminate your account if it violates our Terms, Community Guidelines, or if required by law. We may do so without notice, but we will strive to provide an explanation when feasible.
Account Deletion
You may delete your account at any time from within the App's settings. Upon deletion, we will permanently remove your personal information, including email, username, and other associated data. You can contact us at support@fooddiscoveryapp.com if you require assistance with account deletion.
Governing Law
These Terms shall be governed by the laws of the State of California, excluding its conflict of laws provisions.
Dispute Resolution
Most disputes will be resolved through binding arbitration. Class actions are not permitted. You may opt-out of arbitration within 30 days by contacting us at support@fooddiscoveryapp.com.
Changes to the Terms
We may modify these Terms at any time. We will notify you of changes by posting the updated Terms on the App and revising the "Last Updated" date. Your continued use signifies acceptance of the changes.
