FoodDiscovery Dataset License 1.0

1. Covered material

A “Covered Dataset” is an identified FoodDiscovery CSV file whose guide or download notice links to this license. “Licensed Material” means the FoodDiscovery-created selection, coordination, arrangement, compilation, rankings, analysis, annotations, normalization and other original fields embodied in that file, but only to the extent FoodDiscovery LLC owns or controls copyright, database or similar rights in them. Covered Datasets also record restaurant names, dish names, locations, prices and dates as factual identifiers and observations. This license grants only rights FoodDiscovery can grant, does not claim exclusive rights in facts, and does not limit rights you independently have under applicable law.

2. Permission grant

Subject to these terms, FoodDiscovery LLC grants you a worldwide, royalty-free, non-exclusive license under the copyright, database and similar rights it owns or controls in the Licensed Material, for any lawful purpose, to:

• access, download, copy, reproduce, analyze and combine the Licensed Material with other data;
• perform text and data mining;
• modify, adapt and create derivative datasets, analyses or other works;
• use it for commercial or noncommercial research, journalism, services and products;
• develop, train, test, evaluate, fine-tune and operate artificial-intelligence and machine-learning models or systems;
• use and distribute resulting models and outputs; and
• publish and redistribute the Licensed Material in original or modified form, subject to the attribution requirements below.

3. Attribution

For this section, “Substantial Use” means use of all or a quantitatively or qualitatively substantial portion of a Covered Dataset, measured against that Covered Dataset rather than against a larger training corpus or combined database. When you publicly redistribute the Licensed Material or a derivative dataset, publish an analysis based on a Substantial Use, or publicly release or deploy, operate for external users, or provide public access to an AI or machine-learning model, system or service trained or evaluated using or otherwise incorporating a Substantial Use, provide reasonable attribution: “FoodDiscovery Dataset: [dataset title and canonical source URL], licensed under the FoodDiscovery Dataset License 1.0,” with a link to this license. Attribution may appear in a model card, dataset card, repository, README, API or service documentation, technical documentation or credits page. Retain existing notices and identify material changes. For a private or internal model or system using a Substantial Use, public attribution is not required, but retain the dataset title, canonical source URL and license URL in reasonable internal training-data or evaluation-data records. Individual model outputs do not need attribution unless they reproduce a substantial portion of a Covered Dataset.

4. Third-party rights

This license grants no rights in third-party expressive menu descriptions, promotional copy or other source text, other than the factual identifiers and observations expressly described in Section 1; photographs, artwork, videos or user content; restaurant or platform logos, service marks or trademarks; reviews; source webpages; or privacy, publicity and other rights FoodDiscovery does not control. The expressive-text exclusion does not remove those expressly listed factual identifiers or observations from a Covered Dataset, but this license does not grant trademark rights in any name. A source name or link identifies provenance and does not license the linked material. You are responsible for determining whether separate permission is required.

5. No endorsement

This license does not grant permission to use FoodDiscovery names, logos or trademarks to imply sponsorship, endorsement or an official partnership. Factual attribution is allowed.

6. Disclaimer

Covered datasets are provided “as is,” without warranties of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement. Menu and price observations are time-specific and may differ from current, dine-in or location-specific information. To the extent permitted by law, FoodDiscovery LLC is not liable for losses arising from use of a Covered Dataset.

7. Termination

This permission is irrevocable except upon material breach. Your rights terminate automatically if you materially breach these terms and are reinstated prospectively if you cure the breach within 30 days after discovering it. The exclusions, attribution obligations, trademark restrictions, disclaimers and liability limitations survive termination.

8. Version and questions

Version 1.0 applies to Covered Datasets that link to this exact URL. Later versions do not alter rights already granted under this version. Questions or requests involving excluded material may be sent to support@fooddiscoveryapp.com.
